On January 13, 2025, a significant step was taken in the Florida legislature as State Senator Joe Gruters filed "SB 226 - Smoking in Public Places" to ban smoking in public.
The proposed legislation includes a comprehensive revision of the definitions of "smoking" and "vape" or “vaping.” One key highlight is the outright prohibition of smoking in public spaces, although the bill does outline specific exceptions. Furthermore, it seeks to tighten the requirements for customs smoking rooms, specifically banning the smoking and vaping of marijuana products at any time.
Gruters, a Sarasota Republican, has been an ardent advocate for smoking regulations. He previously campaigned for a beach smoking ban, which led to the 2022 legislation allowing local governments to regulate smoking on beaches and in parks. Gruters is committed to shaping Florida’s smoking policies.
Interestingly, Gruters has faced considerable pushback from various sectors, particularly the cigar industry. In recognition of this resistance, the current bill includes specific exemptions for cigars.
And despite his support for Amendment 3, which aimed to decriminalize marijuana, he doesn't want anything (except cigars) smoked in public, "I think Florida does not want to be like Las Vegas or New York." Inspired by Arizona’s model, which has successfully banned public smoking while allowing for marijuana legalization, Gruters is pushing forward with his legislative agenda despite the prior failure of Amendment 3.
