Big changes are coming to Florida HOA laws!

Here are your new homeowner rights and responsibilities:

  • Know your rules: Every homeowner will receive a copy of the HOA's rules (CC&Rs) by October 1st, 2024.

  • Easier access to records: Starting in 2026, HOAs with 100+ units will allow homeowners to view important documents online.

  • Right to know about fees: You have the right to a detailed breakdown of any HOA fees you owe.

  • Fairer enforcement: The HOA will follow stricter guidelines when enforcing rules. Minor infractions won't be subject to fines anymore.

  • Voting goes digital (optional): HOAs can now offer electronic voting, but only if residents approve it electronically.

  • Fairer Fees: HOAs can only charge simple interest on unpaid fees, not compounded interest.

New HOA board requirements:

  • Board member education: Board members will take educational courses to better understand their roles and responsibilities.

Other changes:

  • Hurricane season prep: The HOA will establish clear guidelines for hurricane protection, giving you more freedom to improve your home's storm protection.

  • HOA websites: Starting January 1, 2025, HOAs with 100 or more units must create websites or mobile apps to post documents.

  • Criminal penalties: There are new penalties for violations within the HOA.

  • Financial requirements: HOAs with 1000 or more units must now prepare audited financial statements. Debit cards are prohibited for HOA expenses.

  • Architectural control: The HOA must enforce architectural standards fairly and cannot regulate invisible changes. Denials of architectural requests must be specific.

  • Storage of items: HOAs cannot restrict storing invisible items from the street or neighboring properties.

  • Fining/Suspensions: There are new rules for fines and suspensions, including time limits and exemptions for minor violations.

  • Vehicle restrictions: HOAs cannot restrict parking of personal vehicles or most work vehicles on private property. They cannot require using a specific vendor list or restrict workers based on licenses.

  • Liens: Compound interest on HOA liens is prohibited.
